All real estate transactions are governed exclusively by the applicable written agreements executed between the parties. 3. Deposits and Refunds
Unless otherwise expressly stated in a written agreement signed by Phoenix Investors or required by applicable law:
- All deposits, application fees, reservation fees, consulting fees, administrative fees, and other payments are final.
- All payments are non-refundable.
- Phoenix Investors has no obligation to issue refunds, credits, or adjustments.
- Payment of a deposit does not guarantee that a transaction will proceed or that a property will be reserved.
4. Right of Withdrawal
Phoenix Investors primarily conducts commercial real estate and business-to-business transactions.
No statutory cooling-off period or right of withdrawal applies unless expressly required by applicable law or specifically provided in a written agreement signed by Phoenix Investors.
Nothing in these Terms limits any non-waivable legal rights.
5. Legal Warranty
To the fullest extent permitted by applicable law, all information, reports, services, property information, and Website content are provided “as is” and “as available.”
Phoenix Investors disclaims all warranties, express or implied, except those that cannot legally be excluded.
Any warranties relating to a specific property or transaction shall be governed solely by the applicable written agreement.

8. Limitation of Liability
To the fullest extent permitted by law, Phoenix Investors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost business opportunities, business interruption, loss of data, or diminution in property value.
Phoenix Investors’ total liability arising from any product or service shall not exceed the amount paid directly to Phoenix Investors for that specific product or service.
9. Indemnification
You agree to defend, indemnify, and hold harmless Phoenix Investors, its affiliates, officers, directors, employees, agents, contractors, successors, and assigns from any claims, damages, liabilities, losses, costs, or expenses, including reasonable attorneys’ fees, arising from:
- Your use of the Website;
- Your violation of these Terms;

- Your violation of applicable law; or
- Your infringement of the rights of any third party.
10. Mediation and Dispute Resolution

Unless otherwise provided in a signed written agreement, these Terms shall be governed by the laws of the State of Wisconsin, and any legal action shall be brought exclusively in the state or federal courts located in Milwaukee County, Wisconsin.
11. Force Majeure
Phoenix Investors shall not be liable for delays or failures resulting from causes beyond its reasonable control, including natural disasters, severe weather, labor disputes, governmental actions, utility failures, cyber incidents, pandemics, acts of terrorism, war, or other force majeure events.
12. Intellectual Property
All content on this Website, including text, graphics, logos, photographs, reports, software, designs, and other materials, is owned by or licensed to Phoenix Investors and is protected by applicable intellectual property laws.
